Refund Policy

Under South Australian Consumer protection law, you are entitled to a refund in the following circumstances:

Section A

(Part 1) The Service for which you have paid did not, or had not, provided the service you were advised it would provide at the time of purchase.

(Part 2) The Service which you have purchased was not provided in accordance with the training times and venues agreed between Sargent Bujinkan Dojos and you the customer (Student).

(Part 3) The service that was paid for was not intended for the purpose for which it was designed and therefore in selling you that service a false belief was created on the part or the customer.

(Part 4) If you notify Sargent Bujinkan Dojos that you will not be continuing training within 7 Days of paying your monthly fees, and in such circumstances the residual monthly fee for that month will be returned to the customer within 7 Days less any training days for that month that have already elapsed or been used.

Note: Such communication in respect of 1/ 4 must be communicated via email or letter.

You are not entitled to a refund if:

Section B

(Part A) You fail to attend and utilise the service that has been paid for simply on the basis that you did not wish to attend, as the service which has been paid for has still been provided by the service provider (Sargent Bujinkan Dojos) in accordance with their obligations.

This section B/A does not apply if part 1/4 above has been enacted and recorded

(Part B) You are not entitled to a refund should you attend lessons for the month paid, and then are of mind that you no longer wish to attend and seek a refund of that month.

This section does not apply if Part A/1 is the case.  Note: The onus of proof in respect of Part A/1 is on the Student, and not on Sargent Bujinkan Dojos.

(Part C) You are entitled to a refund in respect of being diagnosed with a medical condition that prevents you from training for that period for which you have already paid for.

Note: A medical certificate noting that you are unable to train due to a medical condition from a registered medical practitioner will be required as proof.
